Terms of Service – HomeKeep Pty Ltd (Australia)

Welcome to HomeKeep (“HomeKeep”, “we”, “us” or “our”). We provide subscription-based home maintenance services through our website located at www.homekeep.com.au (the “Service”). These Terms of Service (“Terms”) govern your access to and use of the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Your Privacy

We respect your privacy. Please refer to our Privacy Policy for information about how we collect, use, and disclose personal information.

2. Access and Use of the Service

2.1 Service Description

HomeKeep provides subscription-based home maintenance services. Services may be provided by employees or subcontracted Trusted Professionals. HomeKeep manages and coordinates all service providers.

We aim to ensure all services are delivered with reasonable care and skill in accordance with the Australian Consumer Law (ACL). Where services are performed by third parties, HomeKeep will coordinate the delivery but disclaims liability for their conduct to the extent permitted by law.

2.2 Registration Obligations

You may be required to register and provide accurate information to use some features of the Service. You must be at least 18 years old to use the Service.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account and password. Notify us immediately of any unauthorised use.

2.4 Service Modifications

We may modify, suspend or discontinue parts of the Service at any time. We are not liable for any modification or discontinuation.

2.5 Data Storage and Limits

We may set limits on data storage and usage. We may delete inactive accounts with prior notice.

3. User Conduct

You agree not to use the Service for any unlawful or harmful activity. You may not:

  • Upload malicious or unauthorised content

  • Interfere with the Service

  • Violate any applicable Australian laws

  • Impersonate others

  • Collect or misuse data from users

4. Subscription Fees and Billing

4.1 Fees

You agree to pay the applicable fees as per your subscription. Payments are processed via our third-party provider, Stripe. By using Stripe, you agree to their terms.

4.2 Recurring Billing

Subscriptions are billed monthly in advance. You authorise automatic recurring billing until you cancel.

4.3 Price Changes

We may update pricing with 30 days’ notice. Continued use after price changes constitutes acceptance.

4.4 Refunds and Cancellations

You can cancel at any time. Refunds are provided in accordance with the Australian Consumer Law. If our service fails to meet consumer guarantees, you may be entitled to a remedy.

5. Consumer Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to:

  • A refund or replacement for major failures

  • Compensation for foreseeable loss

  • Remedies for services not provided with due care and skill

6. Intellectual Property

All intellectual property in the Service remains the property of HomeKeep or its licensors. You may not copy, reverse-engineer, or distribute our content unless permitted.

7. User Content

You retain ownership of content you upload, but grant us a licence to use, modify, and distribute it to operate the Service. We reserve the right to remove content that violates these Terms.

8. Third-Party Services

Our Service may link to third-party platforms. We are not responsible for their content or conduct. Use them at your own risk and comply with their terms.

9. Copyright Complaints

If you believe your copyright is infringed, email us at info@homekeep.com.au with:

  • Your contact details

  • Description of the work and the infringing material

  • A statement of good faith belief

We will investigate and take appropriate action.

10. Dispute Resolution

We aim to resolve disputes quickly and fairly. If you have a concern, contact us at info@homekeep.com.au. If we cannot resolve it, you may seek assistance from a consumer protection agency or tribunal (e.g., NCAT in NSW).

11. Limitation of Liability

To the extent permitted by law, we exclude liability for:

  • Indirect or consequential losses

  • Loss of data or profits

  • Service interruptions or delays

Our liability under the ACL is limited to resupplying the services or refunding the amount paid.

12. Termination

We may suspend or terminate your account for violations of these Terms. You may cancel your account at any time. Upon termination, access to your data and account may be removed.

13. Governing Law

The laws of New South Wales, Australia, govern these Terms. You submit to the exclusive jurisdiction of the courts of New South Wales.
